These Terms of Service and User Agreement govern your access to and use of Prept360, including any related websites, progressive web applications, tools, features, content, subscriptions, artificial intelligence features, location-based features, notifications, integrations, and services.
By creating an account, accessing, or using Prept360, you agree to these Terms. If you do not agree, you may not use Prept360.
This document establishes the rules, limitations, responsibilities, disclaimers, and privacy expectations for the use of Prept360.
Prept360 is a private productivity, planning, wellness, organization, fitness, trails, calendar, and personal goal-management application.
The app may allow users to create, store, and manage information such as to-dos, notes, planner entries, grocery lists, routines, goals, habits, fitness-related entries, wellness-related entries, calendar events, location-based trail data, affirmations, AI-generated content, and other personal content.
Prept360 is not a medical device, healthcare provider, emergency service, financial advisor, legal advisor, therapist, nutritionist, personal trainer, or substitute for professional advice.
You must be at least 13 years old to use Prept360.
If you are under the age of majority in your jurisdiction, you may only use Prept360 with the consent of a parent or legal guardian.
By using Prept360, you represent that you have the legal authority to enter into this agreement.
To use certain features, you may need to create an account.
You agree to provide accurate, current, and complete information when creating or updating your account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to use a strong password and to notify us promptly if you believe your account has been accessed without authorization.
Tension360 LLC is not responsible for losses caused by your failure to protect your account credentials, device access, or login information.
You retain full ownership of all content you create, upload, enter, import, generate, or store in Prept360, including but not limited to:
Prept360 does not claim ownership of your private content.
By using Prept360, you grant Tension360 LLC a limited, non-exclusive, worldwide, revocable license to process your content solely as needed to operate and provide the service to you.
This includes the ability to:

We do not use your private content for advertising, marketing, or promotional purposes.
We do not access, review, or disclose your private content except as necessary to provide the service, comply with the law, prevent abuse, protect users, resolve support issues, maintain security, improve app functionality, process features you choose to use, or enforce these Terms.
You agree to use Prept360 only for lawful purposes and in accordance with these Terms.

Prept360 may include features related to productivity, habits, planning, wellness, fitness, grocery lists, routines, affirmations, personal goals, fitness trails, outdoor activity, or general lifestyle organization.
These features are provided for informational and organizational purposes only.
Prept360 does not provide medical advice, diagnosis, treatment, nutrition counseling, mental health counseling, therapy, professional coaching, emergency assistance, or healthcare services.
You should consult a qualified professional before making decisions related to your health, fitness, diet, medication, medical treatment, mental health, physical activity, or safety.
You are solely responsible for how you use information entered into or generated by Prept360.
Do not disregard professional advice or delay seeking professional help because of anything in the app.
If you are experiencing a medical emergency, call emergency services immediately.
Physical activity involves risk.
You should consult a physician or qualified healthcare professional before beginning any fitness, exercise, stretching, nutrition, wellness, trail, route, outdoor activity, or lifestyle program, especially if you have a medical condition, injury, disability, are pregnant, are recovering from illness, or have been advised by a healthcare professional to limit physical activity.
Stop immediately if you experience pain, dizziness, shortness of breath, chest pain, faintness, unusual discomfort, or any other concerning symptoms.
You are solely responsible for determining whether any activity, workout, routine, trail, route, station, exercise, or wellness plan is appropriate for you.
Tension360 LLC is not responsible for injuries, health issues, damages, or losses resulting from your use of Prept360 or from your participation in any activity planned, tracked, suggested, stored, generated, or organized through the app.
You are solely responsible for your actions and decisions based on information you enter into, receive through, generate with, or rely on in Prept360.
Any workouts, routines, grocery lists, habits, goals, wellness plans, productivity plans, reminders, trail routes, map pins, calendar events, AI outputs, affirmations, recommendations, or personal plans are used at your own risk.
You agree to use your own judgment and seek professional advice where appropriate.
Prept360 should not be used for emergencies, urgent medical needs, medication-critical alerts, safety-critical reminders, or any time-sensitive situation where failure, delay, inaccuracy, deletion, or unavailability could result in harm.
We do not guarantee that reminders, notifications, push notifications, sync, data, app access, location features, stored information, calendar data, AI outputs, alerts, or backups will be timely, accurate, complete, available, or recoverable.
Device settings, browser settings, notification permissions, battery settings, internet access, third-party outages, operating system behavior, web push provider behavior, calendar provider behavior, location permission settings, and other factors may prevent reminders, alerts, sync, notifications, exports, backups, or location-based features from working properly.
Prept360 may help users organize tasks, goals, routines, workouts, meals, habits, wellness plans, trails, calendar events, affirmations, or personal productivity systems, but we do not guarantee any specific result, outcome, improvement, health benefit, fitness result, productivity gain, habit formation, financial result, personal achievement, emotional improvement, or lifestyle change.
Your results depend on many factors outside our control, including your own actions, consistency, environment, health status, personal circumstances, and decisions.
Prept360 may contain errors, delays, omissions, sync issues, data loss, outdated information, inaccurate information, corrupted information, unavailable information, or incomplete information.
You should not rely on Prept360 as your only record for important information.
You are responsible for maintaining independent backups or records of important tasks, health information, appointments, calendar events, routines, plans, reminders, goals, location information, or other critical data.
Prept360 includes backup-related functionality for certain user data, including backend backup functions and calendar backup features. However, Tension360 LLC does not guarantee that all user content will always be available, backed up, recoverable, preserved, synced, complete, or free from loss, deletion, corruption, overwrite, sync error, or technical failure.
You understand and agree that your data may be lost, deleted, corrupted, delayed, overwritten, or become unavailable due to software bugs, user error, device issues, account issues, password issues, third-party service failures, outages, cyber incidents, maintenance, system changes, subscription issues, app updates, provider limitations, backup failure, export failure, or other causes.
Prept360 should not be used as the only storage location for important, critical, medical, legal, financial, safety-related, or time-sensitive information.
You are responsible for maintaining your own independent copies, backups, screenshots, exports, or records of any information you consider important.
To the fullest extent permitted by law, Tension360 LLC is not responsible or liable for any loss, deletion, corruption, inability to access, inability to recover, failure to preserve, failure to sync, failure to export, or failure to back up user content or data.
Prept360 may include calendar-related features, including calendar synchronization, calendar backup, calendar import, calendar export, and downloadable calendar files.
If you connect a third-party calendar service, such as Google Calendar, you authorize Prept360 to access, process, store, sync, back up, or export calendar data as needed to provide the features you choose to use.
Calendar exports, including .ics files, may not include every type of calendar data, metadata, attachment, reminder, integration, recurrence rule, or third-party calendar detail.
Prept360 does not guarantee that calendar sync, backup, import, export, reminders, recurring events, time zones, or calendar integrations will always be accurate, complete, timely, available, or recoverable.
You are responsible for reviewing calendar data and maintaining your own copies of important events.
Prept360 includes or may include location-based features, fitness trails, map pins, user-submitted stations, route tracking, route visualization, route planning, challenges, nearby trail or station discovery, and similar features.
Location, trail, map, route, and fitness-station information may be inaccurate, incomplete, outdated, unsafe, closed, unavailable, inaccessible, or submitted by users.
You are responsible for evaluating your surroundings, obeying all laws, respecting private property, avoiding unsafe areas, using proper equipment, and exercising good judgment.
Tension360 LLC does not guarantee the safety, legality, accessibility, condition, accuracy, suitability, or availability of any trail, location, route, fitness station, map pin, outdoor area, user-submitted location, or route-tracking feature.
You use all location-based, trail-based, map-based, route-based, and fitness-station information at your own risk.
If users are permitted to submit pins, stations, descriptions, ratings, votes, comments, photos, routes, or other location-related information, users are solely responsible for the accuracy, legality, and appropriateness of their submissions.
You may not submit false, misleading, unlawful, unsafe, private, infringing, defamatory, or unauthorized location information.
We may review, reject, edit, remove, disable, or moderate user submissions at our discretion, but we are not obligated to monitor all submissions.
Prept360 includes or may include artificial intelligence, automated suggestions, automated planning tools, recommendation features, summaries, personalized affirmations, affirmation audio, chat assistance, generated content, smart recommendations, predictive insights, natural-language processing, personalized coaching, or other automated outputs.
AI-generated or automated outputs may be inaccurate, incomplete, outdated, inappropriate, offensive, unavailable, or unsuitable for your circumstances.
You are responsible for reviewing, verifying, and using your own judgment before relying on any AI-generated or automated output.
Prept360 does not guarantee the accuracy, safety, suitability, completeness, reliability, or usefulness of AI-generated or automated content.
AI-generated content should not be treated as medical, legal, financial, nutritional, mental health, fitness, safety, or professional advice.
You should not submit sensitive information to AI features unless you are comfortable with that information being processed to provide the feature.
Prept360 may rely on third-party platforms, browsers, hosting providers, application infrastructure providers, analytics providers, payment processors, authentication providers, calendar providers, customer support tools, cloud storage providers, crash-reporting tools, email providers, database providers, artificial intelligence providers, map providers, push notification services, and other service providers.
These third-party providers may include, without limitation, Google services, OpenAI, Stripe, web push notification services, browser vendors, operating system providers, and payment providers.
These third-party providers may process certain data on our behalf only as necessary to provide their services to us.
We are not responsible for failures, outages, acts, omissions, terms, policies, data practices, security practices, or service interruptions of third-party services outside our control.
Your use of third-party services may be subject to their own terms and privacy policies.
Prept360 is provided as a progressive web application and may be accessed through browsers, devices, operating systems, and third-party platforms that are not controlled by Tension360 LLC.
Your use of Prept360 may depend on browser settings, device settings, operating system permissions, notification permissions, internet access, location permissions, third-party services, and platform behavior.
Tension360 LLC is not responsible for browser limitations, device issues, operating system restrictions, notification failures, permission settings, internet outages, third-party service interruptions, or other platform-related issues outside our control.
Your use of browsers, devices, operating systems, Google services, payment processors, notification services, calendar providers, map providers, or other third-party platforms may also be subject to their own terms and privacy policies.
Some features of Prept360 may require payment or a subscription.
Pricing, billing terms, renewal terms, cancellation procedures, and refund rules will be disclosed at the time of purchase.
Prept360 uses or may use Stripe or another third-party payment processor to process payments, subscriptions, invoices, billing events, and related account information.
Your payment information may be handled directly by Stripe or another payment processor according to that provider's own terms and privacy policy.
Unless otherwise stated, subscriptions automatically renew until canceled.
You are responsible for canceling before renewal if you do not want to continue the subscription.
We may change pricing, features, or subscription terms from time to time. Any material pricing changes will apply at the next renewal period unless otherwise stated or required by law.
Tension360 LLC is not responsible for payment processor outages, declined payments, bank fees, card issuer issues, payment method errors, or third-party billing interruptions outside our control.
Some features may be experimental, incomplete, or released as beta features.
Beta or experimental features may change, break, disappear, produce inaccurate results, or be discontinued at any time.
We are not liable for reliance on beta, test, preview, or experimental features.
Prept360 may be available to users in multiple countries and may support multiple languages.
Availability may vary by country, region, language, browser, operating system, legal requirement, technical limitation, payment provider, service provider, or business decision.
Prept360 may not be available in certain restricted regions. We may restrict, suspend, or terminate access where required by law, sanctions, export controls, provider rules, payment processor rules, platform limitations, or business reasons.
You are responsible for complying with the laws that apply to you in your location.
Prept360, including its design, software, code, features, trademarks, logos, branding, text, graphics, workflows, content, and other materials, is owned by Tension360 LLC or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, or create derivative works from Prept360 unless we give you written permission or applicable law allows it.
Your personal content remains yours.
Our app, brand, software, platform, and intellectual property remain ours.
If you submit feedback, suggestions, ideas, bug reports, feature requests, or other comments about Prept360, you grant Tension360 LLC the right to use that feedback without restriction, obligation, or compensation to you.
This does not give us ownership of your private account content.
If you believe content in Prept360 infringes your copyright, contact us at customercare@tension360.com with:
We may remove or disable allegedly infringing content and may terminate accounts of repeat infringers where appropriate.
You may request deletion of your account through the app settings or by contacting customercare@tension360.com.
When we delete your account, we will delete or de-identify associated personal data within a reasonable period unless we are required or permitted to retain certain information for legal, tax, accounting, security, fraud prevention, backup, dispute-resolution, or legitimate business purposes.
Deleted records from data tables may remain restorable for up to 30 days, after which they are permanently removed, subject to legal, technical, provider, or backup limitations.
If backup systems are used, backup copies may remain for a limited period before being overwritten or deleted according to our backup retention practices. However, Tension360 LLC does not guarantee that backups will exist, that backups will include all user data, or that deleted, corrupted, lost, or unavailable data can be recovered.
Prept360 currently allows users to export calendar data through the Calendar Backup feature in Settings, which may allow users to download calendar events as an .ics file.
Prept360 may or may not provide general export functionality for all user data. If general export functionality becomes available, it may be limited by technical, legal, or service-provider constraints.
We may suspend or terminate your access to Prept360 if:
You may stop using Prept360 at any time.
Termination does not limit any rights or obligations that should reasonably survive termination, including intellectual property rights, disclaimers, limitations of liability, indemnification, dispute resolution provisions, and payment obligations.
We aim to provide a reliable service, but we do not guarantee that Prept360 will be uninterrupted, error-free, secure, accurate, complete, backed up, recoverable, or available at all times.
The service may be unavailable due to maintenance, updates, outages, third-party service failures, security issues, internet disruptions, browser problems, hosting issues, payment processor issues, provider limitations, operating system changes, device issues, account issues, restricted-region limitations, sanctions compliance, or events outside our control.
We may modify, suspend, discontinue, replace, limit, or remove any feature or part of Prept360 at any time, with or without notice, subject to applicable law.
We are not liable for any modification, suspension, discontinuation, limitation, or removal of any feature or service.
Tension360 LLC is not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, labor disputes, internet outages, cyberattacks, war, terrorism, civil unrest, government action, browser disruption, hosting disruption, payment processor disruption, platform disruption, third-party provider failure, power failure, pandemic, provider restrictions, sanctions, export-control restrictions, or other events outside our control.
Prept360 is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Tension360 LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, uninterrupted operation, data preservation, data recovery, successful sync, successful export, notification delivery, and error-free performance.
We do not guarantee that the service will meet your expectations, produce specific results, be free from errors, be secure, preserve data, recover data, export data, sync data, deliver notifications, or operate without interruption.
To the fullest extent permitted by law, Tension360 LLC, its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, deleted data, corrupted data, unrecoverable data, failed backups, failed exports, failed sync, missed notifications, business interruption, personal injury, emotional distress, reputational harm, loss of goodwill, loss of opportunity, or loss of use arising from your use of or inability to use Prept360.
To the fullest extent permitted by law, Tension360 LLC's total liability for any claim related to Prept360 will not exceed the greater of:

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
You and Tension360 LLC agree that New Jersey law applies to these Terms and to any dispute related to Prept360, unless applicable law requires otherwise.

You agree to provide your name, contact information, a description of the dispute, and the relief you are seeking.
Tension360 LLC will attempt to respond and resolve the issue within 30 days.
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to Prept360, these Terms, or your use of the service will be resolved through binding individual arbitration rather than in court, except that either party may bring qualifying claims in small claims court.
You and Tension360 LLC agree that disputes will be handled only on an individual basis and not as part of a class action, collective action, consolidated action, private attorney general action, or representative proceeding.
You waive any right to participate in a class action or class-wide arbitration.
This arbitration and class action waiver section should be reviewed by an attorney before publication. Arbitration clauses are highly technical, and enforceability may depend on exact wording, notice, opt-out rights, location, arbitration provider, fees, and applicable state law.
We may update these Terms from time to time.
If we make material changes, we will notify users through the app, by email, or by another reasonable method.
The updated Terms will become effective on the date stated in the notice or updated document.
Your continued use of Prept360 after the effective date means you accept the updated Terms.

Prept360 currently includes a Calendar Backup feature in Settings that allows users to export calendar events as an .ics file.
If you choose to enter health, fitness, nutrition, wellness, habit, affirmation, or routine-related information, we may store and process that information to provide the features you use.
You should not enter sensitive medical information unless you are comfortable storing and processing it in the app.
Prept360 uses or may use location-based features, primarily for Tension Trails and related map, trail, route, and fitness-station functionality.
If you grant permission or use location-based features, we may collect or process location information to:
You may be able to disable location permissions through your device or browser settings, but some features may not function properly without location access.
We may collect technical and usage information such as device type, operating system, browser type, app version, IP address, crash logs, diagnostic data, pages or features used, session activity, notification status, feature usage, and general usage patterns.
Analytics data is retained according to our analytics provider's retention settings, which are currently expected to be 30 days for the applicable plan.
If you purchase a subscription or paid feature, payment information may be processed by Stripe or another payment processor.
We generally do not store full credit card numbers.
If you enable notifications, Prept360 may process push notification tokens, subscription identifiers, notification preferences, and related technical information needed to deliver web push or device notifications.
Web push notifications may rely on platform services such as Google, Apple, browser vendors, operating system providers, or other notification infrastructure.
If you contact us for support, we may collect your email address, message content, screenshots, attachments, account details, and other information needed to respond.
If Prept360 allows users to submit feedback, location pins, ratings, votes, photos, descriptions, support tickets, routes, trail details, or other submissions, we may collect and process that information to operate, improve, moderate, and support the service.

If you choose to connect or use Google-related features, Google services may be used for authentication, calendar synchronization, calendar access, or other supported integrations.
Your use of Google services may be subject to Google's own terms and privacy policies.
Prept360 uses or may use OpenAI or other artificial intelligence providers to provide AI assistant features, chat interactions, personalized affirmations, affirmation audio, recommendations, summaries, natural-language processing, personalized coaching, or other AI-powered features.
Information submitted to AI features may be processed by AI providers as necessary to provide the requested functionality.
You should not submit sensitive information to AI features unless you are comfortable with that information being processed to provide the feature.
If you subscribe or purchase through Stripe or another payment provider, those providers may process payment, subscription, refund, and account-related information according to their own terms and privacy policies.
If you enable notifications, Prept360 may use web push notification services and platform notification services, which may include browser vendors, operating system providers, Google, Apple, or other notification infrastructure, to deliver notifications.
We may use analytics, diagnostics, crash-reporting, or performance tools to understand general usage patterns, fix bugs, improve features, and maintain reliability.
These tools may collect technical and usage information such as device type, app version, crash logs, session activity, notification status, and feature usage.
We do not authorize analytics providers to access your private user-generated content for their own advertising or marketing purposes.
We may disclose information if required by law, subpoena, court order, legal process, government request, or regulatory requirement.
We may disclose information if we believe it is necessary to protect the rights, safety, security, or property of Tension360 LLC, Prept360, our users, the public, or others.
If Tension360 LLC or Prept360 is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, user information may be transferred as part of that transaction.
If this happens, we will take reasonable steps to protect user information and notify users where required.

AI-generated outputs may be inaccurate, incomplete, outdated, or unsuitable for your circumstances. You are responsible for reviewing and verifying outputs before relying on them.
We use reasonable administrative, technical, and organizational safeguards designed to protect user information from unauthorized access, disclosure, alteration, loss, or misuse.
These safeguards may include encryption, access controls, authentication protections, secure hosting, monitoring, backups where implemented, and restricted access to user data.
However, no system is completely secure.
We cannot guarantee absolute security.
We also cannot guarantee that user data will always be available, preserved, backed up, synced, exported, or recoverable.
You are responsible for protecting your account credentials, device access, and copies of information you consider important.
We retain personal information for as long as reasonably necessary to provide Prept360, maintain your account, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and operate our business.
User content is generally retained while your account remains active.
Analytics data is currently expected to be retained for 30 days under the applicable analytics plan.
Deleted records from data tables may remain restorable for up to 30 days, after which they are permanently removed, subject to legal, technical, provider, and backup limitations.

Even though Prept360 is currently offered as a progressive web application, we recommend maintaining both an in-app account deletion option and an external account deletion request method, such as a public account deletion page or support form. This gives users a clear way to request deletion even if they cannot access their account.

Prept360 is available only where permitted by applicable law, service-provider restrictions, sanctions rules, export controls, platform rules, payment provider rules, and business limitations.
Users in restricted regions may be unable to access some or all features.
